Siming District Trade and Industry Bureau: Four stores suspected of infringing underwear sales
On the morning of yesterday, following a report and formal request from the trademark owner, the Siming District Administration for Industry and Commerce launched four specialized inspection teams. These teams conducted surprise inspections at several major retail locations, including Zhongshan Road, Tacoma Commercial City, Station World Trade Mart, Jiahe Road, Tengteng Rainbow, and the Atlantic Ocean, specifically targeting stores such as Rainbow A Supermarkets and "Ben Fun" bench-body stores. During the inspections, officials discovered a number of products suspected of infringing on the exclusive rights of the Bench trademark. These items were immediately seized on the spot.
According to the business operators, the Bench trademark is officially registered with the China Trademark Office, and the products sold under the "bench-body" label are clearly marked with the brand name. However, this placement could potentially mislead consumers about the origin of the goods. The store owners were unable to provide the official trademark registration certificate, raising further concerns about the legitimacy of their products. Preliminary investigations suggest that some of the underwear sold in these stores may be infringing on Bench's trademark rights.
Some of the stores were found to be using similar or identical trademarks without authorization, selling products that closely resemble those of the registered trademark holder. This practice could constitute trademark infringement under Chinese law. If the allegations are confirmed, the involved parties may face penalties, including fines of up to three times the amount of illegal business operations, as stipulated in Article 52 of the Implementation Regulations of the Trademark Law. In cases where the illegal turnover cannot be determined, fines of up to 100,000 yuan may be imposed. The investigation is ongoing, and further legal actions will be taken based on the findings.
