Siming District Trade and Industry Bureau: Four stores suspected of infringing underwear sales
On the morning of yesterday, following a report and request from the trademark owner, the Siming District Administration for Industry and Commerce dispatched four specialized inspection teams to conduct surprise checks at several key retail locations. The inspections took place at well-known commercial areas including Zhongshan Road, Tacoma Commercial City, Station World Trade Mart, Jiahe Road, Tengteng Rainbow, and the Atlantic Ocean, specifically targeting stores such as Rainbow A Supermarkets and "Ben Fun" bench-body stores.
During the inspections, officials discovered a number of products suspected of infringing on the exclusive rights of the Bench trademark, particularly in the underwear category. These items were immediately confiscated on-site. Store operators were unable to provide the official trademark registration certificate, raising further concerns about the legitimacy of their products.
According to the business owners, the Bench trademark is officially registered with the China Trademark Office. However, the stores in question were selling products labeled as "bench-body," which prominently featured the Bench logo in a way that could easily mislead consumers regarding the product's origin. This led to suspicions of trademark infringement.
Preliminary investigations indicate that some of the stores may be selling underwear that violates Bench's trademark rights by using similar or identical trademarks without authorization. If proven, this violation could result in penalties under Article 52 of the Implementation Regulations of the Trademark Law. The potential fines could reach up to three times the amount of illegal business operations. In cases where the illegal gains cannot be determined, a fine of up to RMB 100,000 may be imposed.
The case is currently under investigation, and further actions will be taken based on the findings. Authorities have emphasized the importance of protecting intellectual property rights and ensuring fair competition in the market. Consumers are also encouraged to remain vigilant and purchase products from authorized retailers to avoid counterfeit goods.
